Wi-Fi Terms of Service

By accessing and using the Cyberonic Wi-Fi Network and Internet Service, you agree that you have read, understand, and accept the Terms and Conditions below for all use. If you do not agree to this policy, it is recommended that you do not use this service.
1. Cyberonic Wi-Fi Network and Internet Service is intended for the general use of its customers. Customers from properties participating in our amenity based program have permission to use the Cyberonic Wi-Fi Network and Internet Services.

2.Users may not use this network in any manner that is in violation of Cyberonic policies, including but not limited to transmitting defamatory, obscene, pornographic, offensive, insulting or harassing material or messages or other language that may be offensive to another user.

3.Users may not use this network to gain unauthorized access to other systems or programs.

4.Users may not use this network to operate any music and/or video sharing programs, as these are illegal.

5.Users may not copy and/or download commercial software or other material (e.g. music) in violation of federal copyright laws.

6.Users may not use this network to transmit any material which would be in violation of any local, state, or federal law. This includes, but is not limited to: copyrighted materials, threatening or obscene material, or material protected by trade secret.

7.Any form of vandalism, including but not limited to, damaging computers, computer systems, or networks, and/or disrupting the operation of the network is prohibited.

8.The network may not be used for illegal activity, e.g. hacking.

9.The network may not be used for creating and/or placing a computer virus on the network. These services are provided on an as is basis and on an as available basis. Cyberonic does not warrant that either the service will be uninterrupted, error-free or free of viruses or their harmful components.

Additionally, Cyberonic does not warrant that the information on the client computer or the information that is available on the network or Internet is secure or private. Client is responsible for protecting any private information by using software or hardware devices such as personal firewalls. Cyberonic makes no warrantee and no guarantee, expressed or implied, including, but not limited to, those of merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, miss-deliveries or service interruption, however caused, or the security of data including the data broadcasted on the network or un-secure data available on client computers. Use of any information obtained by Cyberonic's network is at Client's own risk.

Client waives and releases all claims and causes of action accrued at any time and whether known or unknown, against Cyberonic and its directors, officers, employees, agents, representatives, subcontractors, suppliers, successors and assigns (Cyberonic Parties) for any and all loss and damage caused in the whole or part by Cyberonic Parties and/or your use of the services. If this waiver and release is not given full effect, then the total amount of any liability of Cyberonic Parties, including all attorney fees and costs, shall not exceed the total fees actually paid by Client for the services (excluding amounts paid for other goods or service provided by the company and its affiliates) for the one month preceding receipt by Cyberonic of written notice of your claim.

Cyberonic reserves the right to terminate this Agreement and the services to Client. This Agreement is governed by Massachusetts law without regard to conflict of law provisions. The federal and state courts located in Massachusetts alone have jurisdiction over all disputes arising out of or related to this Agreement and the Services. Cyberonic may modify these terms and conditions upon written notice published on its website, www.cyberonic.com. Client's continued use of service after such notice shall constitute Client's acceptance of the modification of this Agreement implied in fact. I have read and understand this acceptable use policy. I agree to abide by the above guidelines and understand that failure to comply with these guidelines may result in termination of my rights to use the Cyberonic Network.
